1.1 - This contract ("Contract") is a distance contract under art. 50 et seq. of Legislative Decree 6 September 2005, No. 206 ("Consumer Code"). The Contract concerns the sale of movable goods between Euro Frutta Izzo SRL Via Contrada Piana n. 65 Zona Industriale - 82030 Ponte (BN), and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Euro Frutta Izzo SRL of a purchase proposal issued by the Customer via the internet, following the invitation to offer contained on the website https://www.eurofruttaizzo.com/ (the "Site"), based on the terms described in the following article 3.
1.2 These general sales conditions ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by Euro Frutta Izzo SRL and reported on the Site, shall remain valid and effective until they are modified and/or supplemented by Euro Frutta Izzo SRL. Any changes and/or additions to the General Conditions shall be effective from the date they are communicated to the public and shall apply to sales made from that date. The latest updated version of the General Conditions can be found on the Site.
1.3 In compliance with current laws regarding the purchase of wines and alcoholic beverages and considering its commercial policy, Euro Frutta Izzo SRL reserves the right not to process orders from individuals other than "consumers" in accordance with its commercial policy and in compliance with the age limits set by law for the purchase and delivery of wine and alcoholic beverages. Euro Frutta Izzo SRL does not sell wine and alcoholic beverages to persons under 18 years of age. By using our website https://www.eurofruttaizzo.com/, you guarantee that you are over 18 years of age and that the person receiving the shipment from Euro Frutta Izzo SRL will also be over 18 years of age.
3.1 - Purchases of available products, as illustrated and described online in their technical data sheets, are made by the customer at the current price indicated, including VAT, to be confirmed at the time of placing the order, plus shipping costs and, in any case, displayed at the time of purchase. Functions and features described in the technical data sheets are provided by the Manufacturer. Euro Frutta Izzo SRL disclaims all liability for any changes or inaccuracies. The photos used for product sheets, while reflecting their main characteristics, may differ in color or some details.
3.2 - Before confirming the purchase, the customer will be provided with a summary of the unit cost of each selected product, the total order amount, the total cost of the order in case of purchasing multiple products, and any shipping charges.
3.3 - Upon confirmation of the purchase acceptance, the customer will receive an email message.
3.4 - The customer will be allowed to choose one of the payment methods clearly listed on the website and accepted by Euro Frutta Izzo SRL.
3.5 - For product warranty purposes (as required by a 24-month law), the confirmation of the order sent by Euro Frutta Izzo SRL upon the customer's purchase completion shall prevail. For online sales, which are equivalent to mail-order sales for VAT purposes, the certification requirement is exempted. These sales are not subject to the obligation to issue an invoice unless requested by the customer during the order phase (only individuals with VAT numbers), and they are also exempt from the certification requirement through a receipt or fiscal receipt (Article 22 of Presidential Decree No. 633/1972) pursuant to Article 2 of Presidential Decree 21 December 1996, No. 696.
4.1 - Euro Frutta Izzo SRL delivers the products to the address indicated by the Customer within 30 (thirty) days from the conclusion of the Contract, as provided by the Consumer Code; in the case of orders with advance bank transfer, the products are delivered within 30 working days from the date of payment receipt by our bank.
4.2 - The customer is required to verify, upon receipt, the conformity of the product delivered to him with the order placed; the customer must sign the delivery note, indicating "subject to inspection of product integrity"; if this does not happen, the customer cannot make any complaints about the external characteristics of what was delivered to him and its compliance with what was ordered.

4.4 - The delivery of the goods takes place "EX-WORKS SELLER." The clause "EX-WORKS SELLER" included in the contract means that the goods must be delivered to the customer/buyer or his delegate (e.g., carrier) at the seller's warehouse. All costs related to the transportation of the goods are borne by the buyer, as are the related risks.
Products purchased through Euro Frutta Izzo SRL are covered by the warranties provided by the current legal regulations. This warranty applies exclusively to malfunctions that occur despite the normal use of the product, that is, in compliance with its functions and what is provided in any technical documentation, and in compliance with the various operating rules indicated. The product warranty does not apply in the case of negligence, misuse, maintenance, or connection to electrical or other non-compliant systems. The warranty is personal and will therefore only apply to the original purchaser. Before returning a product under warranty, you will be emailed an Authorization Return Number (ARN), which must be indicated on the product's packaging, which must be sent together with the sales/order document to Euro Frutta Izzo SRL VIA SALA, 36. Euro Frutta Izzo SRL will reject any product returned unpackaged or incomplete, as well as products for which the return costs have not been fully paid by the customer. In the case of replacement of a product with a new or substitute product, the warranty still begins from the purchase of the first product. Euro Frutta Izzo SRL is not responsible, neither towards third parties nor towards the customer, for any damage or loss of goods sold by it due to manufacturing defects. In terms of the warranty, these responsibilities fall under the exclusive competence of the manufacturer. Returns are free throughout Italy.
Sales of products via the Internet are governed by Legislative Decree No. 206/05 (articles 50 to 68), which regulates distance contracts, i.e., those concluded outside of commercial premises. This regulation establishes the right of withdrawal, i.e., the possibility for the consumer to return the purchased product and obtain a refund of the amount spent. This right is reserved exclusively for individuals (consumers), therefore it cannot be exercised by legal entities and individuals acting for purposes related to their professional activity, if any. To exercise the right of withdrawal, it is necessary to send a communication within 10 working days from the receipt of the goods, in which the will to withdraw from the contract is clearly expressed. The communication must be sent by registered letter with return receipt, as required by law. According to Article 55, second paragraph, of the Consumer Code, the customer shall not have the right of withdrawal in the following cases: · supply of audiovisual products or sealed software opened by the customer; · supply of products made to measure or personalized, or that, by their very nature, cannot be returned or risk deteriorating or altering rapidly (e.g., food, cosmetics, flowers, etc.); · supply of newspapers, periodicals, magazines. The costs of returning the product are borne by the CUSTOMER. The right of withdrawal will lapse entirely if the returned product is not intact, i.e.: · in the absence of integral elements of the product (accessories, cables, instruction manuals, etc.); · if the product is damaged for reasons other than its transport. In the event of withdrawal of the right of withdrawal, Euro Frutta Izzo SRL will return the purchased product to the sender, charging the customer for the return shipping costs.
The goods are mainly shipped by the courier GLS, a specialized logistics operator for the transport of perishable foodstuffs at controlled temperatures. Order processing usually takes place the day after purchase if you choose "Credit Card or Bank transfer" as the payment method, or the day after payment is credited if you choose "Bank Transfer." You can choose the service you prefer for the pickup of our products; you can also pick up the goods at our headquarters in person or through authorized persons/carriers at no additional cost. Delivery times vary depending on the chosen service. With express courier, the times for receiving the goods from the order fulfillment are 24-48 hours for all destinations within the national territory, excluding Calabria, Sicily, Sardinia, and smaller islands, which have estimated times of 48-72 hours from the order fulfillment. We pay special attention to the packaging of our gastronomic specialties. To ensure the perfect preservation and integrity of perishable products, we use thermal packaging for food use in expanded polystyrene and dry ice for temperature-controlled packaging, a gel in a bag that allows regulating the internal temperature of the containers to maintain the cold chain unaltered. You can also reuse the gel bag at home by storing it in the freezer. Proper storage is the first rule for a satisfying sensory experience of the product and contributes to enhancing its typical characteristics. We recommend that you provide a shipping address where someone can be reached during working hours, as the courier will require a signature for receipt. You can choose the home address, but also the workplace, a neighbor, friend, or relative's address. It is essential that someone is present at the indicated address at the time of delivery to avoid delivery delays and storage at the courier's warehouse. Pursuant to art. 5 of Legislative Decree 185/1999, the customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. To exercise this right, the customer must send a communication to Euro Frutta Izzo SRL within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with return receipt, addressed to: Euro Frutta Izzo SRL Via Contrada Piana n. 65 Zona Industriale - 82030 Ponte (BN); or by email, sent also within the aforementioned 10-day period and followed by a registered letter with return receipt. Once we receive the communication of withdrawal, the Customer Service of Euro Frutta Izzo SRL will provide the customer with instructions on how to return the goods, which must be received by Euro Frutta Izzo SRL within 10 days of authorization.
the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product; by law, the shipping costs related to the return of the item are the responsibility of the customer; the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
in case of damage to the goods during transport, Euro Frutta Izzo SRL will inform the customer of the incident (within 5 working days from receipt of the goods in its warehouses) to allow the customer to file a complaint with the chosen courier and obtain a refund of the value of the item (if insured). In this case, the product will be made available to the customer for its return, simultaneously canceling the withdrawal request; Euro Frutta Izzo SRL is not responsible in any way for damage or theft/loss of returned goods without insurance. Euro Frutta Izzo SRL will refund the customer the entire amount already paid, retaining the "shipping costs," within 30 days from the return of the goods, through a refund procedure of the amount debited on the Credit Card or by Bank Transfer. In the latter case, it will be the responsibility of the customer to provide the bank details on which to receive the refund (ABI code - CAB - Current Account of the invoice holder).
The right of withdrawal completely lapses if the returned product is not intact, i.e.: in the absence of external packaging and/or the container containing the purchased product; if the product is damaged for reasons other than its transport. In the event of the forfeiture of the right of withdrawal, Euro Frutta Izzo SRL will return the purchased product to the sender, charging the customer for the return shipping costs.
